is fixed, and although an occasional case may occupy time
there is a sufficient margin of time available for other cases.
As to the further contention that the proposal
6.
may increase speculative actions without the check afforded
by the independent position of Counsel, I think it is not
unlikely that Counsel would be instructed in many other capes
that would otherwise have been heard in Original Jurisdiction.
Both Judges would of course be available and if a cage is of
sufficient weight to carry Counsel it would probably be tried
by the Chief Justics, whilst the Pulzne Judge carried on the
smaller work of the Summary Court.
In my opinion no sufficient reason has been
advanced for delaying the speedy re-arrangement of the work
of the Courts by a transfer of such cases from Original
Jun@d:otion as may fitly be taken in the Summary Court.
The proposal should I think involve some asteration in the existing scale of costs so as to adapt it
to the altered conditions of the Oourt.
8.
I am addressing Your Excellency under separate
cover as to certain suggestions made by the Bar and solicitors
on the question of expediting the work of the Courts in the
conditions at present existing.
His Excellency
Sir Henry May, K.C.M.G.,
Governor, do....
I have to*,
(sd.) W. Rees-Davies,
Chief Justice.
